These Terms set out the basis on which we provide the below services and operate our website. By using this website or receiving the services, you accept these Terms.

Summary of Services

Consents Online Limited is an Account Information Service Provider (AISP) registered with the FCA. With your consent, our services enable you to give us access to your online financial account transactions (Transaction Data), so that we can then consolidate this information to make it easier to digest and understand, and make it available to those third parties which you expressly authorise to receive it.

For example, if you are applying for loan the lender may invite you to share your Transaction Data over the past 12 months so that the lender can assess your ability to repay the loan. The lender may then direct you to Consents Online so that we can access your online account, with your explicit consent, and facilitate the sharing of Transaction Data and our analysis of it with your lender.

Please note that at no point will Consents Online have access to, store or share your online banking credentials, such as passwords or access codes

1. INFORMATION ABOUT US AND THESE TERMS.

1.1 Who are we?  Consents Online Limited is an Equifax group company incorporated in England and Wales under company number 10904754, whose registered office is at 1 Angel Court, London, EC2R 7HJ ("consents.online" or "us" or "we" or "our"). The consents.online (Website) is operated by consents.online.

Consents Online Limited is authorised and regulated by the Financial Conduct Authority as an Account Information Service Provider (AISP) under Firm Reference Number (FRN) 792642. Consents Online Limited is also registered with the Financial Conduct Authority for the provision of Credit Information Services under FRN 838090.

1.2 What these terms cover. These Terms of Use and our Privacy Policy (see below) govern the relationship between consents.online and you in relation to accessing the online portal provided by us via our Website and the services described in these Terms of Use and on the Website (Services). These are the terms and conditions on which you must comply with when viewing and accessing the Service.

1.3 Why you should read them. Please read these Terms carefully before you register for an account with consents.online or use the Service. These Terms tell you who we are, details of the Services and how we will provide the Service to you, details of how you and we may cancel the Services, what to do if there is a problem, and other important information. If you think that there is a mistake in these Terms please contact us.

1.5 How we may contact you. If we have to contact you we will do so by writing to you at the email address you provided or by sending you a text message to the mobile phone number you provided to us on registration for an account to access the consents.online portal.

2. WHEN AND HOW THESE TERMS APPLY.

2.1 Transaction Data: You may be required to allow your chosen service provider to undertake certain checks for the specific purposes as listed in the reason for access in the consent you provide. The consents.online portal allows you to control how data from your online bank accounts (Bank Account) is used by your chosen service provider. Using our Service you are able to link your Bank Account to an account you set up on our online portal which will allow you to tell us how you want to control the access rights to your Bank Account data. For example, you will be able to tell us the:

If your data needs to be used by your chosen service provider for the purpose of assessing your credit status then your Bank, will need access to this data.

2.2 To use our Services you will have to have agreed to these Terms of Use and our Privacy Policy, both of which may change over time. You should check the Website for the most recent versions of the Terms of Use and Privacy Policy. Please read these terms carefully.

3. CREATING AN ACCOUNT ON THE CONSENTS.ONLINE PORTAL.

3.1 If you choose to opt in to automatically-register with consents.online we will create an account for you using the information you have provided to us. An email will be sent to you so that you can log into your automatically-registered account with consents.online. If you choose to not opt-in for automatic-registration you will receive an email from consents.online offering you the chance to register for a free account with consents.online. You are under no obligation to opt into automatic account creation or to create an account. The consents.online service is designed so you can manage your consent and view your transaction data at any time.

3.2 Consents.online will use your mobile phone number to send an SMS text message with a one-time passcode to validate the consent provided. The one-time passcode will be used to access your transaction data and verify consent against your registered account.

3.3 To gain access to the consents.online portal you will have to create an account with consents.online (Account) on the Website. Your account on the Website (Account) is for use by the named person only. When you register for an Account, we ask you to provide certain information about yourself that is true, accurate, and up to date. Should any of your registration information change, please log into your account, go to "Settings" and make the required changes.

3.4 We have the right to disable your Account or withdraw or suspend your access to the Service at any time if in our reasonable opinion you have failed to comply with any of the provisions of these Terms. We will contact you to tell you we are suspending your access to the Account and Service.

4. PASSWORD AND SECURITY

4.1 On registration you will select a username and password and supply an email address. You must keep your password secure and must not disclose it to or share it with anyone. You are responsible for keeping your account details safe and secure.

4.2 You will be responsible for all activities and content uploaded onto your 'Profile' which is accessed by using your password. If you know or suspect that someone else has your password, you should go to "Settings” and change it yourself and if this is not possible please contact us.

4.3 We reserve the right to change your password if we believe that it is no longer secure.

4.4 If you forget your password please click the "Forgot Password?" link where you will be able to reset your password if you satisfy our security check.

5. HOW WILL WE USE YOUR INFORMATION?

5.1 Transaction Data: Where you provide third parties with your consent to share your data, you accept that the following process will be undertaken to access, use and retrieve your Transaction Data:

5.2 We will not make payments or transfer funds to third parties or otherwise operate any other functionality on your Bank Account. Our access, the access of your chosen service provider as instructed by you and the access of your Bank will be limited to the process set out in clauses 5.1 and 5.2 and will be in accordance with your instructions.

5.3 You acknowledge and accept that your internet banking provider may not endorse or sponsor consents.online or any of our associates or business partners. You also accept that consents.online can be responsible for your bank's terms and conditions and whether or not you comply with them as a customer.

5.4 You acknowledge and accept that your chosen service provider who receives your Transaction Data via this Service may use the Transaction Data results to make decisions to lend to you and collect repayments from you and/or make decisions about which lenders to refer you to, so that these lenders can decide if they want to lend to you.

5.5 To the extent that, in the provision of our services, we suspect or detect any fraud or security threats relevant to your use of our services, we will contact you either through the contact details you have provided, the Consents.Online portal or via any other secure means, as appropriate.

6. OUR RESPONSIBILITY TO YOU

6.1 You accept that neither we nor our partners will have any responsibility to you resulting from whether or not a decision is made by your chosen service provider to provide you with the service or product you have applied for. We will therefore have no liability to you in relation to the timing of providing you with credit, the amount of credit provided, the potential lenders available to you. We will also have no liability to you if we are otherwise unable to deliver the Service or perform our obligations under these Terms of Use due to:

6.2 We are providing you with access to your online profile for free so we will not accept responsibility for any losses suffered by you. Except that we do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury arising from our negligence and for fraud or fraudulent misrepresentation or for any representation that fundamentally misrepresents the nature of the Service we provide to you. Nothing in these Terms of Use will exclude or limit any of your legal rights as a consumer.

6.3 Except to the extent that we are liable to you under these Terms of Use, you agree to indemnify us against any third party claims that are directly caused by:

6.4 We only supply the Service for domestic and private use. If you use the Service for any commercial, business or re-sale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

7. PRIVACY POLICY

7.1 We gather data and certain other information about you which is subject to our Privacy Policy, which can be accessed here: https://www.consents.online/Privacy.You should make sure that you read the Privacy Policy carefully as it contains important information about our use of your personal data.

7.2 By using the Service, you agree that all data provided by you is accurate.

7.3 We will not pass your Internet Banking Credentials to any third parties without your instruction. Unless we state otherwise in these Terms of Use or our Privacy Policy, where we refer to sharing information with third parties, we are not referring to sharing your Internet Banking Credentials or raw Transaction Data.

7.4 All data that we or our agents hold on you including the Transaction Data results may be disclosed by us or our agents when legally required to do so at the request of government authorities conducting an investigation; we also use it to verify or enforce compliance with the policies governing our website and applicable laws or to protect against misuse or unauthorised use of our website.

8. TERMINATION

8.1 You can cancel access to your Account and stop the Service at any time by logging onto the account and deleting the account.

8.2 We reserve the right to suspend or terminate your online profile account at any time for business, operational, regulatory, legal or other reasons. We do not guarantee to continue to make your Account available.

8.3 On termination of these Terms of Use for any reason, all rights granted to you under these terms immediately cease and we will stop providing the Service to you. You may notify us at any time if you no longer want us or any third party to use or access your Transaction Data and/or Bank Account.

9. OTHER TERMS THAT MAY APPLY TO YOU

9.1 There may be other terms that apply to you when you use the Service.

9.2 We may make changes to the terms. We may amend these Terms of Use at any time by amending this page. We will provide reasonable notice of any change which is likely to materially impact use of the Service, but please check this page from time to time as any changes will be binding on you if you continue to use the Service.

9.3 We may make changes to the Service. We may update the Service from time to time and may change any of the content that is uploaded by us at any time. However, we are under no obligation to update the Service and we do not guarantee that the Service, or any content on it, will be free from errors or omissions.

9.4 Availability of the Service. By using the Service, you acknowledge that the Service is provided on an "as is" and "as available basis". We do not guarantee that the Service will always be available or be uninterrupted. We may suspend or withdraw or restrict availability of all or any part of the Service at any time for routine maintenance, release of upgrades to the Service, or at our reasonable discretion. We will try to give you reasonable notice of any suspension or withdrawal.

9.5 We are not responsible for other websites the Service links to. Where the Service contains links to other sites and resources provided by third parties, these links are provided for your information only. Such links should not be interpreted as approval by us of those linked websites or information you may obtain from them. We have no control over the contents of those sites or resources. You will need to make your own independent judgement about whether to use any such independent sites.

9.6 Viruses. We do not guarantee that the Service will be secure or free from bugs or viruses. You are responsible for configuring your information technology, computer programmes and platform to access the Service. You should use your own virus protection software. You must not misuse the Service by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to the Service, the server on which the Service is stored or any server, computer or database connected to the Service. You must not attack the Service via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use the Service will cease immediately.

9.7 Nobody else has any rights under these terms. This agreement is between you and us. No other person shall have any rights to enforce any provision in these Terms of Use or in the Privacy Policy. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these Terms of Use or in the Privacy Policy.

9.8 Which laws apply to this agreement and where you may bring legal proceedings. These Terms of Use and our Privacy Policy are governed by English law. Any disputes you and we cannot settle may be resolved by the courts in the country where you live but only in accordance with English law. Any communication we send you will be in English.

10. COMPLAINTS AND COMPENSATION

10.1 If you are not happy with the Service, we have provided to you, you may complain by writing to us, consents.online, at 1 Angel Court, London, EC2R 7HJ. Alternatively, you can send your complaint to us at the following email address enquiries.consents@equifax.com We will try to resolve your complaint in line with our complaint’s procedure, which you can find on our website. We will write back to you within fifteen days to let you how we propose to resolve your complaint. If you agree with our suggested solution, we will resolve the complaint accordingly.

10.2 However if you are not happy with the way in which we have sought to resolve your complaint you may refer your complaint to the Financial Ombudsman Service.
